Terms of Service

1. Acceptance of Terms

By accessing or using Konda ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Konda is a couples and relationship app designed to help partners stay connected through shared activities, communication features, widgets, games, photos, planning tools, and other relationship features. The Service includes:

User accounts authenticated via Sign in with Apple
Sending and receiving nudges (predefined messages with emojis)
Managing contacts and connections
Creating and managing groups
Viewing nudge history and streaks
Apple Watch companion app
Push notifications
Sending and receiving snap photos (ephemeral photo messages) with approved connections
Moments, a couples feature for paired partners where each partner submits a photo for a shared Moment; photos remain hidden from the other partner until both have posted, after which both may view each other’s photos for 24 hours starting when the second partner posts
Couples Corner shared features for paired/approved partners, including Moments; Photo Booth, which allows paired partners to select shared scenes and ideas, contribute photos, create persistent collages from revealed Moments, and save, share or print those collages; Photo Frame, which lets paired partners send photos to each other’s Home Screen widget, retain up to five photos from each partner in private in-app history, and react to those photos, shared reminders, countdowns, mood updates, Daily Question, This or That, You Or Me?, Date Match, Date Jar, Our Book, which includes Sketchpad shared drawing pages, collaboratively edited Notebook pages and a shared Dictionary for words, phrases, definitions and examples, and virtual gifts
Today Together, a Couples Corner feature that gives paired partners a shared daily activity and allows them to create Memories and maintain related Spark progress.

Virtual Features: The Service may include virtual features such as streaks, levels, XP, widgets, virtual pets, virtual items (including pet food), and in-app currencies such as gems and hearts. These virtual features have no real-world monetary value, do not constitute property, are not redeemable for cash or real-world goods or services, and are non-transferable.

The Service may also include virtual gifts that users can send to connections using in-app currencies (gems and hearts). Virtual gifts are for entertainment only, have no monetary value, cannot be exchanged for cash or real-world goods, and cannot be refunded after being sent.

Gems and hearts are in-app currencies that are earned through app activity, such as completing challenges and other in-app actions. Gems and hearts are not sold directly for real money. Subscribers may receive additional gems and hearts as part of their subscription benefits, such as higher earn rates over time and bonus rewards from completing certain challenges.

Couples Games and Compatibility Results: The Service may include couples games, including "You Or Me?" and compatibility-style results based on your and your partner's in-app responses. These games and any compatibility scores, percentages, or results are provided for fun and entertainment only. They are not professional advice, psychological assessments, relationship counseling, or guarantees about your relationship, and should not be relied upon for important personal decisions.

We reserve the right to modify, adjust, reset, limit, suspend, or remove any virtual features, balances, pets, or virtual items at any time, including as part of feature updates, balance changes, abuse prevention, account termination, or Service changes.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have permission from a parent or legal guardian to use the Service.

By using the Service, you represent and warrant that:

You are at least 13 years of age
You meet the eligibility requirements to use the Service
You will comply with all applicable laws and regulations

4. Account Registration

4.1 Account Creation

You must create an account using Sign in with Apple to use the Service
Your use of Sign in with Apple is subject to Apple's terms and conditions
We only receive the information that Apple provides to us through Sign in with Apple
We do not have access to your Apple ID or password
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
You must provide accurate and complete information when creating your account

4.2 Username Requirements

Your username must:

Be 4-15 characters in length
Start with a letter (A-Z, a-z)
Contain only English letters, numbers, and underscores
Contain at least one letter
Not contain consecutive underscores
Not contain spaces or special characters
Be unique and not already taken
Not be offensive, abusive, obscene, misleading, or violate the rights of others
Not impersonate another person, company, or entity, or imply an official affiliation

Usernames are case-insensitive. Once set, your username cannot be changed. We may add an option later to allow username changes.

4.3 Display Name (Nickname)

Your display name can be 1-20 characters
Display names can include letters, numbers, emojis, and various scripts
Display names cannot contain control characters or invalid characters
You can change your display name at any time

4.4 Account Responsibility

You are solely responsible for:

All activities that occur under your account
Maintaining the confidentiality of your account credentials
Notifying us immediately of any unauthorized use of your account

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to:

Use the Service in a respectful and appropriate manner
Respect the privacy and rights of other users
Comply with all applicable laws and regulations

5.2 Prohibited Conduct

You agree NOT to:

Harass, bully, threaten, or intimidate other users
Send spam, unsolicited messages or connection requests
Impersonate any person or entity
Use the Service for any illegal or unauthorized purpose
Attempt to gain unauthorized access to the Service or other users' accounts
Interfere with or disrupt the Service or servers
Use automated systems to access the Service without permission
Collect or harvest information about other users
Use the Service to transmit any malicious code or viruses
Violate any applicable local, state, national, or international law
Use shared features, including Couples Corner, Moments, and Photo Frame, to harass, monitor, manipulate, threaten, or abuse another user
Share illegal, sexually exploitative, hateful, or otherwise prohibited content through shared content features, including Moments, Snap photos, and Photo Frame
Attempt to capture, redistribute, or publish another user’s Moments, Snap photos, or Photo Frame photos outside the Service without permission

6. User Content

6.1 Your Content

You retain ownership of any content you create or submit through the Service, including:

Your username and display name
Nudges you send
Doodles you send
Groups you create
Your profile photo
Snap photos you send (photo messages)
Moments photos you submit for a shared Moment with your paired partner
User-created Photo Booth scenes, shared idea text, and the photos or other content you contribute to Photo Booth collages. Note: A Photo Booth collage may combine content contributed by both partners and may include backgrounds, scenes, patterns, templates or other assets provided by Konda. You retain any rights you hold in content you contributed, but you do not obtain ownership of content contributed by your partner or assets owned or licensed by Konda.
Photo Frame photos you send to your paired partner
Content you create in Couples Corner, including Moments, shared reminders, countdowns, mood updates, Daily Question answers, This or That responses, You Or Me? responses, Date Match activity, Date Jar notes or activity, and Our Book content, including Sketchpad drawings and pages, Notebook page titles, written content and formatting, and Dictionary words, phrases, definitions and examples
Content you submit through Today Together, including written responses, voice recordings, photos, drawings, selected places, song selections, wishes, and time-capsule notes.
Virtual gifts you send to connections and optional messages included with them

6.2 License to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

Store, process, and transmit your content as necessary to provide the Service
Display content you choose to share to its intended approved connection or paired partner as part of the Service’s functionality.
Use your content for the purpose of operating, maintaining, and improving the Service

6.3 Content Standards

You are solely responsible for the nudges, groups, Moments photos, Photo Booth scenes and ideas, and other content you create and share. We reserve the right to:

Remove any content that violates these Terms
Suspend or terminate accounts that violate these Terms
Take appropriate legal action against users who violate these Terms

6.4 Media and Shared Content

If you upload or send a profile photo, doodle, Snap photo, Moments photo, Photo Frame photo, Photo Booth scene, shared Photo Booth idea, Photo Booth collage, Today Together content, voice recording, or other media through the Service, you agree that such content must not:

Contain nudity, sexual content, or pornography
Depict minors in a sexualized or exploitative manner
Contain hateful, violent, or extremist content
Harass, threaten, or abuse others
Infringe intellectual property or privacy rights
Contain illegal content under applicable law

You must have the necessary permission or legal right to submit another person’s voice, image, private information, music, or other copyrighted content.

We reserve the right to remove profile photos, Moments photos, Snap photos, Photo Frame photos, Photo Booth scenes, ideas and collages, Today Together content, voice recordings, or other media that violate these Terms, and to suspend or terminate accounts associated with such violations.

Photo Booth is a shared feature. Your paired partner may view shared scenes and ideas, change or remove an active idea or scene where the feature permits, and delete shared collages or user-created scenes. Deleting shared content may remove it from both partners’ Couple Space and cannot necessarily be undone.

6.5 Reporting Content

Users may report content they believe violates these Terms or applicable law. We may review reported content and take appropriate action, including removal of content, restriction of features, or account termination.

If you encounter content that you believe violates our Terms or is abusive or illegal, you may report it by contacting us at the email address at the bottom of this page.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The privacy policy can be viewed at https://getkonda.app/privacy

8. Subscriptions

Certain features of the Service require a paid subscription purchased through the Apple App Store. Subscriptions are billed and managed by Apple, renew automatically unless cancelled, and can be managed or cancelled at any time through your Apple ID subscription settings. We do not collect or store payment information. All billing issues and refund requests are handled by Apple in accordance with its policies.

Some subscription plans may allow a subscriber to generate a redeem code that grants subscription access to one additional user (a “Couple Redeem Code”).

Redeem codes are intended for personal, non-commercial use only.
Redeem codes may not be sold, resold, traded, transferred for value, or distributed publicly.
Each redeem code may be redeemed only once, unless otherwise specified.
We reserve the right to limit, revoke, or invalidate redeem codes or related subscription access if we detect misuse, abuse, fraud, or violations of these Terms.

Redeem codes have no cash value and do not constitute property or ownership rights.

Subscription benefits may include access to premium features and increased in-app rewards, such as earning gems and hearts at higher rates or receiving bonus gems and hearts from completing certain challenges. These virtual rewards are part of the Service’s entertainment features, have no cash value, and are not sold separately.

9. Data Storage and Sync

9.1 Data Storage

The Service uses a combination of storage systems:

Stored on Our Servers:

Your account information (username, display name, Sign in with Apple user identifier, profile photo)
Contact relationships and connection requests
Nudge chat history
Couples Corner data, including Photo Booth idea and scene selections, collage metadata, Sketchpad pages and drawing data, Notebook pages, text formatting and collaboration history, and Dictionary entries
Today Together written responses, selected places, song information, activity state, Spark progress, and Memories metadata.
Device tokens for push notifications

Stored in Object Storage (non-public):

Profile photos, doodle images, and Sketchpad snapshot files
Today Together photos, drawings, and voice recordings.
Snap photo content, Moments photo content, and Photo Frame photos, stored in object storage — Snap and Moments content only temporarily for delivery and viewing, then deleted as described in our Privacy Policy; Photo Frame photos, including the current widget photo and recent in-app history, are stored until deleted by the sender, automatically removed after exceeding the five-photo-per-partner history limit, deleted with an account, or removed following the archived-pair retention period described in our Privacy Policy
User-created Photo Booth scene images, Photo Booth collage images and collage thumbnails. Photo Booth collages are stored separately from their source Moments photos and may remain available after those Moments photos expire, until either partner deletes the collage, an associated account is deleted, or the content is removed under the archived-pair retention process described in our Privacy Policy.

Stored in Apple CloudKit in your iCloud (if enabled):

Nudge history (synced from server for cross-device access)
Groups you create
Favorited contacts
Reflections journal entries

Stored Locally on Your Devices:

Cached data for offline access
Temporary data for app functionality
Reflections journal entries

We use industry-standard security measures to protect your data across all storage systems, including encryption in transit, hardened infrastructure, and access controls. However, no method of transmission or storage is 100% secure. You use the Service at your own risk, and we cannot guarantee absolute security.

9.2 Data Sync

Your nudge history and groups sync across your devices using Apple's CloudKit service
Contact relationships and account data are managed on our servers
Data may be cached locally on your devices for offline access
We are not responsible for data loss due to device failure or loss
Notebook and Dictionary content may be synchronized between paired devices through our servers. Synchronization may be delayed or interrupted by connectivity problems, device state, software errors, account or subscription status, or service availability.

9.3 Unpairing

Unpairing does not delete either user’s account. Persistent shared Couples Corner content may remain archived for the 90-day reconnection period described in the Privacy Policy. If the same pair does not reconnect during that period, the archived shared content is permanently deleted through routine cleanup.

10. Account Termination

10.1 Termination by You

You may delete your account at any time through the Settings section of the App. When you delete your account:

Associated account data will be permanently deleted within a reasonable period, subject to any limited retention necessary for security, fraud prevention, legal compliance, or enforcement of these Terms as described in our Privacy Policy. This includes Today Together responses and media, Memories, account information, profile photos, contacts, nudge history, Snap photos, Moments photos, Photo Frame photos, and user-created Photo Booth scenes and collages.
We will attempt to delete all your CloudKit data (nudge history, groups, and favorited connections stored in your iCloud)
Your username will become available for reuse by other users
Your contacts will no longer see you in their inbox
This action cannot be undone

Important:

Account deletion requires an active internet connection. If you attempt to delete your account while offline, the deletion will fail and you will need to try again when you have an internet connection. Your account and data will remain intact until the deletion process successfully completes on our servers.
While we attempt to delete all CloudKit data from your iCloud account, deletion of CloudKit records is subject to Apple's CloudKit service limitations and may not always complete successfully. Some CloudKit data may remain in your iCloud account if deletion fails due to network issues, CloudKit service errors, or other technical limitations. However, you will no longer be able to access this data through the App after account deletion.
If you wish to ensure all iCloud data is removed, you can manually delete the app's iCloud data through your Apple device settings: Settings → [Your Name] → iCloud → Manage Storage → [App Name] → Delete Data. We do not have direct access to or control over data stored in your personal iCloud account.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

Violation of these Terms
Illegal activity
Fraudulent or harmful behavior
Any other reason we deem necessary to protect the Service or other users

10.3 Effect of Termination

Upon termination:

Your right to use the Service will immediately cease
All data associated with your account will be deleted as described above
You will not be entitled to any refund or compensation

11. Intellectual Property

11.1 Our Rights

The Service, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 Your Rights

You retain ownership of your user content, but grant us the license described in Section 6.2.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE

We do not warrant that:

The Service will be uninterrupted or error-free
Defects will be corrected
The Service is free of viruses or other harmful components

Certain features of the Service, including widgets and notifications, may depend on device capabilities, operating system behavior, system permissions, or third-party services. We do not guarantee that these features will be available, timely, or function without interruption.

Snap photos and Ephemeral Content: Snap photos are designed to be ephemeral. However, we do not guarantee that any content will be deleted or become inaccessible within a specific timeframe in all cases. Recipients may be able to capture or retain snap photos (for example, by taking a screenshot, using screen recording, or photographing the screen with another device). You are responsible for the content you choose to share through snap photos.

Moments: Moments are designed for temporary sharing between paired partners. Until both partners have posted, each partner’s photo remains hidden from the other but may be stored on our servers. You may remove your own photo before your partner posts. After both partners have posted, both photos may be viewed for 24 hours, beginning when the second partner posts, and are then deleted as described in our Privacy Policy. We do not guarantee deletion or inaccessibility in every technical circumstance. Your partner may capture Moments content using screenshots, screen recording, or other methods outside the app. You are responsible for the photos you choose to submit.

Photo Booth:Photo Booth collages are persistent content and are separate from the temporary Moments photos used to create them. Deleting or automatically expiring the original Moments photos does not delete a collage that was previously created from those photos. Either paired partner may be able to save, share, print or delete a shared collage. Once a collage is saved, shared, printed, captured by screenshot or otherwise copied outside Konda, we cannot control or delete those external copies. Photo Booth scenes, collages and printed output may differ in appearance, color, cropping, resolution or quality depending on the source photos, selected layout, device, printer, system software and third-party services. We do not guarantee uninterrupted synchronization or that offline changes will be uploaded or processed immediately.

Photo Frame: Photo Frame shows the latest photo sent by your partner on the widget and may retain up to five photos sent by each partner in private in-app history. Photo Frame photos are not ephemeral and may remain stored until deleted or automatically removed under the retention rules described in our Privacy Policy. Your partner may capture them using screenshots or other methods outside the App. You are responsible for the photos you choose to send.

Notebook and Dictionary: Notebook and Dictionary are general-purpose shared features and are not designed as a password manager, secure vault, medical record system, financial record system or emergency information service. You should not store passwords, authentication codes, payment card details, banking credentials, government identification numbers, medical information required for urgent care, or other information requiring specialized protection. It is generally recommended to use an appropriate dedicated service, such as a reputable password manager, for that information.

Content availability and backups: We use reasonable measures to store and synchronize Notebook, Dictionary and other shared content, but we do not guarantee that content will always be available, synchronized without delay, or recoverable. Content may be affected by device failure, connectivity problems, conflicting edits, user deletion, account or pairing changes, third-party service interruptions, maintenance or software defects. You should keep an independent copy of information that you cannot afford to lose.

Shared and Real-Time Features: Features including Sketchpad, Notebook, Dictionary, Moments and other Couples Corner features depend on internet connectivity, device state, paired-account status and backend availability. We do not guarantee uninterrupted real-time collaboration, immediate delivery, conflict-free synchronization or restoration of shared state in every circumstance. A paired partner may view, change, copy or delete shared content where the feature permits, and you are responsible for choosing what you share.

Third-Party Music Services: Today Together may use Apple Music, the iTunes Search API, Spotify, or other third-party services to provide song searches, previews, and external listening links. Availability may vary by region, account, subscription, or third-party service. Use of those services is subject to their respective terms and privacy policies.

Legal and Safety Requirements: We may preserve, access, or disclose content and related information if we believe it is reasonably necessary to comply with applicable law, enforce these Terms, protect the rights, property, or safety of users or others, or investigate fraud, abuse, or security issues.

Not for Emergency Use: The Service is not intended for emergency communications or urgent situations where life, safety, or property is at risk. Do not rely on Konda for emergency alerts, critical notifications, or time-sensitive communications. Always use appropriate emergency services or communication methods.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the Service
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

14. Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party right, including without limitation any intellectual property or privacy right

15. Changes to Terms

We reserve the right to modify these Terms at any time. When required by law, or when we determine a change is material, we may provide notice using one or more of the following methods:

Posting the new Terms on this page
Updating the "Last Updated" date
Providing notice through the App

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
