Terms of Service

1. Acceptance of Terms

By accessing or using Konda ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Konda is a mobile application that allows users to send and receive brief pre-written messages called "nudges" to stay connected with friends and family. The Service includes:

  • User accounts authenticated via Sign in with Apple
  • Sending and receiving nudges (predefined messages with emojis)
  • Managing contacts and connections
  • Creating and managing groups
  • Viewing nudge history and streaks
  • Apple Watch companion app
  • Push notifications
  • Sending and receiving snap photos (ephemeral photo messages) with approved connections

Virtual Features: The Service may include virtual features such as streaks, levels, XP, widgets, virtual pets, virtual items (including pet food), and in-app currencies such as gems and hearts. These virtual features have no real-world monetary value, do not constitute property, are not redeemable for cash or real-world goods or services, and are non-transferable.

We reserve the right to modify, adjust, reset, limit, suspend, or remove any virtual features, balances, pets, or virtual items at any time, including as part of feature updates, balance changes, abuse prevention, account termination, or Service changes.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have permission from a parent or legal guardian to use the Service.

By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You meet the eligibility requirements to use the Service
  • You will comply with all applicable laws and regulations

4. Account Registration

4.1 Account Creation

  • You must create an account using Sign in with Apple to use the Service
  • Your use of Sign in with Apple is subject to Apple's terms and conditions
  • We only receive the information that Apple provides to us through Sign in with Apple
  • We do not have access to your Apple ID or password
  • You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
  • You must provide accurate and complete information when creating your account

4.2 Username Requirements

Your username must:

  • Be 4-15 characters in length
  • Start with a letter (A-Z, a-z)
  • Contain only English letters, numbers, and underscores
  • Contain at least one letter
  • Not contain consecutive underscores
  • Not contain spaces or special characters
  • Be unique and not already taken
  • Not be offensive, abusive, obscene, misleading, or violate the rights of others
  • Not impersonate another person, company, or entity, or imply an official affiliation

Usernames are case-insensitive. Once set, your username cannot be changed. We may add an option later to allow username changes.

4.3 Display Name (Nickname)

  • Your display name can be 1-20 characters
  • Display names can include letters, numbers, emojis, and various scripts
  • Display names cannot contain control characters or invalid characters
  • You can change your display name at any time

4.4 Account Responsibility

You are solely responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your account credentials
  • Notifying us immediately of any unauthorized use of your account

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to:

  • Use the Service in a respectful and appropriate manner
  • Respect the privacy and rights of other users
  • Comply with all applicable laws and regulations

5.2 Prohibited Conduct

You agree NOT to:

  • Harass, bully, threaten, or intimidate other users
  • Send spam, unsolicited messages or connection requests
  • Impersonate any person or entity
  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Collect or harvest information about other users
  • Use the Service to transmit any malicious code or viruses
  • Violate any applicable local, state, national, or international law

6. User Content

6.1 Your Content

You retain ownership of any content you create or submit through the Service, including:

  • Your username and display name
  • Nudges you send
  • Doodles you send
  • Groups you create
  • Your profile photo
  • Snap photos you send (photo messages)

6.2 License to Us

By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and transmit your content as necessary to provide the Service
  • Display your content (such as your username and profile photo) to other users as part of the Service's functionality
  • Use your content for the purpose of operating, maintaining, and improving the Service

6.3 Content Standards

You are solely responsible for the "nudges" and "groups" you create and share. We reserve the right to:

  • Remove any content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Take appropriate legal action against users who violate these Terms

6.4 Media Content (Profile Photos, Doodles, and Snaps)

If you upload or send a profile photo, doodle, Snap photo, or other media through the Service, you agree that such content must not:

  • Contain nudity, sexual content, or pornography
  • Depict minors in a sexualized or exploitative manner
  • Contain hateful, violent, or extremist content
  • Harass, threaten, or abuse others
  • Infringe intellectual property or privacy rights
  • Contain illegal content under applicable law

You represent and warrant that you have all necessary rights to upload and send your media content, and that you have permission from any identifiable individuals appearing in it, as required by applicable law.

We reserve the right to remove profile photos or other media that violate these Terms, and to suspend or terminate accounts associated with such violations.

6.5 Reporting Content

Users may report content they believe violates these Terms or applicable law. We may review reported content and take appropriate action, including removal of content, restriction of features, or account termination.

If you encounter content that you believe violates our Terms or is abusive or illegal, you may report it by contacting us at the email address at the botom of this page.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. The privacy policy can be viewed at https://getkonda.app/privacy

8. Subscriptions

Certain features of the Service require a paid subscription purchased through the Apple App Store. Subscriptions are billed and managed by Apple, renew automatically unless cancelled, and can be managed or cancelled at any time through your Apple ID subscription settings. We do not collect or store payment information. All billing issues and refund requests are handled by Apple in accordance with its policies.

Some subscription plans may allow a subscriber to generate a redeem code that grants subscription access to one additional user (a “Couple Redeem Code”).

  • Redeem codes are intended for personal, non-commercial use only.
  • Redeem codes may not be sold, resold, traded, transferred for value, or distributed publicly.
  • Each redeem code may be redeemed only once, unless otherwise specified.
  • We reserve the right to limit, revoke, or invalidate redeem codes or related subscription access if we detect misuse, abuse, fraud, or violations of these Terms.

Redeem codes have no cash value and do not constitute property or ownership rights.

9. Data Storage and Sync

9.1 Data Storage

The Service uses a combination of storage systems:

Stored on Our Servers:

  • Your account information (username, display name, Apple ID identifier, profile photo)
  • Contact relationships and connection requests
  • Nudge history (all nudges sent and received)
  • Device tokens for push notifications

Stored in Apple CloudKit in your iCloud (if enabled):

  • Nudge history (synced from server for cross-device access)
  • Groups you create
  • Favorited contacts
  • Reflections journal entries

Stored Locally on Your Devices:

  • Cached data for offline access
  • Temporary data for app functionality
  • Reflections journal entries

We use industry-standard security measures to protect your data across all storage systems, including encryption in transit, hardened infrastructure, and access controls. However, no method of transmission or storage is 100% secure. You use the Service at your own risk, and we cannot guarantee absolute security.

9.2 Data Sync

  • Your nudge history and groups sync across your devices using Apple's CloudKit service
  • Contact relationships and account data are managed on our servers
  • Data may be cached locally on your devices for offline access
  • We are not responsible for data loss due to device failure or loss

10. Account Termination

10.1 Termination by You

You may delete your account at any time through the Settings section of the App. When you delete your account:

  • All your data will be permanently deleted from our servers (including account information, profile photo, contacts, and nudge history)
  • We will attempt to delete all your CloudKit data (nudge history, groups, and favorited connections stored in your iCloud)
  • Your username will become available for reuse by other users
  • Your contacts will no longer see you in their inbox
  • This action cannot be undone

Important:

  • Account deletion requires an active internet connection. If you attempt to delete your account while offline, the deletion will fail and you will need to try again when you have an internet connection. Your account and data will remain intact until the deletion process successfully completes on our servers.
  • While we attempt to delete all CloudKit data from your iCloud account, deletion of CloudKit records is subject to Apple's CloudKit service limitations and may not always complete successfully. Some CloudKit data may remain in your iCloud account if deletion fails due to network issues, CloudKit service errors, or other technical limitations. However, you will no longer be able to access this data through the App after account deletion.
  • If you wish to ensure all iCloud data is removed, you can manually delete the app's iCloud data through your Apple device settings: Settings → [Your Name] → iCloud → Manage Storage → [App Name] → Delete Data. We do not have direct access to or control over data stored in your personal iCloud account.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Illegal activity
  • Fraudulent or harmful behavior
  • Any other reason we deem necessary to protect the Service or other users

10.3 Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • All data associated with your account will be deleted as described above
  • You will not be entitled to any refund or compensation

11. Intellectual Property

11.1 Our Rights

The Service, including its original content, features, and functionality, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11.2 Your Rights

You retain ownership of your user content, but grant us the license described in Section 6.2.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components

Certain features of the Service, including widgets and notifications, may depend on device capabilities, operating system behavior, system permissions, or third-party services. We do not guarantee that these features will be available, timely, or function without interruption.

Snap photos and Ephemeral Content: Snap photos are designed to be ephemeral. However, we do not guarantee that any content will be deleted or become inaccessible within a specific timeframe in all cases. Recipients may be able to capture or retain snap photos (for example, by taking a screenshot, using screen recording, or photographing the screen with another device). You are responsible for the content you choose to share through snap photos.

Legal and Safety Requirements: We may preserve, access, or disclose content and related information if we believe it is reasonably necessary to comply with applicable law, enforce these Terms, protect the rights, property, or safety of users or others, or investigate fraud, abuse, or security issues.

Not for Emergency Use: The Service is not intended for emergency communications or urgent situations where life, safety, or property is at risk. Do not rely on Konda for emergency alerts, critical notifications, or time-sensitive communications. Always use appropriate emergency services or communication methods.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

14. Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including without limitation any intellectual property or privacy right

15. Changes to Terms

We reserve the right to modify these Terms at any time. When required by law, or when we determine a change is material, we may provide notice using one or more of the following methods:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Providing notice through the App

Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
